After suffering an injury on the job, you should seek medical attention. Your first instinct might be to make an appointment to visit your regular physician or a specialist he or she recommended for you; that might lead you into trouble. It is possible that workers’ compensation may not pay your medical expenses if you go to an unauthorized doctor. You should speak to a knowledgeable attorney to help you identify your legal options.

Can I Choose My Own Doctor?

In Florida, your employer’s workers’ compensation insurance company has some say over which physician you can see for treatment. This is a tactic used by your employer’s insurance company to control the amount of compensation paid, if any. One of their approved physicians will determine if you have an injury and if your injury requires you to miss work. If they do not refer you to a medical specialist, then you may be ineligible to receive worker’s compensation to pay for a specialist you see on your own.

If you feel the approved physician, your employer or its insurer is not acting in good faith, you may need to hire a lawyer to get access to needed benefits. An injured worker has the right to an independent medical exam. An unbiased doctor can be found to conduct your medical exam and he or she will provide you with an evaluation and recommendation for treatment where applicable.
