All remaining debt after liquidating is discharged. The process can take as little as 90 days.

Understanding Chapter 13 Bankruptcy

Alternately, Chapter 13 is an option for those in debt who do not qualify for Chapter 7 bankruptcy because their income exceeds the required threshold. It’s also a viable solution for those who wish to keep certain assets or retain ownership of their home.

Under a Chapter 13 plan, debtors set up a monthly payment plan, typically lasting three to five years. The monthly payment will depend on the individual’s income, expenses and other circumstances.
