To prove that a business is responsible for your injuries, you must show that the entity was negligent. You must demonstrate that the business had actual or constructive knowledge that the floor was slippery or otherwise hazardous.

While actual knowledge is straightforward, constructive knowledge implies that an employee or supervisor should have known that the floor was hazardous to patrons.

Slip and fall claims are based on the following components:

  • Duty of care: The defendant had a duty to take care of its patrons
  • Breach of duty: The defendant violated that duty
  • Causation: As a result of this violation, you suffered an accident and sustained injuries
