Reckless Driving Accidents in Florida

On Behalf of Rosenthal, Levy, Simon & Sosa | April 23, 2023 | Car Accidents

Reckless driving is defined as operating a motor vehicle in a way or at a speed that shows blatant disregard for property or other people’s safety. Another way of looking at reckless driving would be that the driver knows they’re driving recklessly but still chooses to do so. In some cases, it can be difficult to determine whether a driver was driving recklessly. In these cases, factors that can be used to determine whether the driver was reckless include:

  • The weather conditions
  • Whether there were other people, like other drivers, passengers, and pedestrians
  • The specific time of day the accident occurred
  • Whether the driver’s actions were beyond simple negligence

Driving Behaviors That Lead to Reckless Driving Accidents in Florida

There are various driving behaviors that can be considered reckless driving. These include, but aren’t limited to, the following:

  • Tailgating – This is the term used when drivers follow the vehicle in front of them too closely. Tailgating is dangerous because when the driver of the leading vehicle needs to stop or slow down suddenly, they risk getting rear-ended by the driver behind them that’s following too closely.
  • Speeding – Speeding is another reckless driving behavior that many drivers do. Sometimes, some drivers may not even recognize that they are speeding and driving recklessly. But this is never an excuse, especially if the speeding driver causes a crash and injures someone. Speed limits are mandatory for a reason, which means driving over the posted limit is automatically considered reckless driving. Speeding significantly reduces the control a driver has over the car, which can lead to more devastating crashes.
  • Aggressive Driving – This umbrella term can include many different dangerous driving behaviors. Cutting off cars at intersections, swerving quickly and unexpectedly, and hurrying other drivers to pull over or make a turn while they are driving safely are the most common examples of aggressive driving.
  • Distracted Driving – Using a cell phone for texting, speaking to someone, or something else, eating, drinking, grooming, arguing with passengers, and tinkering with the radio or climate controls are all considered distracted driving Put simply, anything that may take your attention or sight off the roadway and the surrounding area is considered distracted driving.
