Recent Car Accident Case Studies: Lessons Learned

On Behalf of Rosenthal, Levy, Simon & Sosa | January 2, 2024 | Car Accidents

Car accidents happen in many ways, with many types of resulting injuries. The complexity of a car accident claim largely depends on the circumstances of the crash and severity of injuries in question.

No matter what happened in your collision, if you believe someone else was to blame, always discuss the matter with a South Florida car accident attorney. Below are only some examples of accidents that might lead to complex cases.

Police Search for Liable Drivers

Hit and run accidents can cause complications for victims or their families. For example, two drivers were street racing near the Palm Beach Airport on July 2, 2023, when they caused a fatal crash, causing a 29-year-old woman in another vehicle to lose her life. While families can file wrongful death cases following such accidents, they have fewer options when the police have not located the liable drivers.

In this situation, police officers arrested the two drivers on October 19 and October 26, respectively. After waiting, family members can proceed with a wrongful death car accident claim against the dangerous street racers.

Single-Vehicle Crashes

Very recently, a 21-year-old man was involved in a single-vehicle crash when his car departed I-4 while going eastbound, crossing the grassy area and hitting a concrete pole. The man did not survive, and family members might assume that they have no legal recourse since it was a single-vehicle accident.

However, in some situations, single-vehicle crashes happen due to the negligence of others. Did someone run him off the road? Did a defective car part or road hazard cause him to lose control? Investigations can answer these complicated questions, which can indicate whether a car accident case is possible.

Liability is Disputed

Imagine two drivers were trying to switch into the same lane at the same time and collided. They each point the blame at the other driver. This is a common occurrence after car crashes.

In a scenario where both drivers involved in a car accident dispute liability, determining fault becomes challenging. Without clear evidence or witness statements, each party may blame the other, complicating the legal claim. The absence of a police report or surveillance footage further adds complexity, making it difficult for insurance companies and legal professionals to establish responsibility, potentially leading to a protracted legal battle.

Negligence or Nature?

In another situation, a car accident might occur in adverse weather conditions, such as heavy rain or wind. The challenging road conditions create difficulties in proving negligence or fault.

Insurance companies may argue that the accident resulted from unavoidable weather-related factors, making it difficult for the injured party to establish the other driver's responsibility. However, the other driver might have been driving too fast for the conditions when they lost control.

This situation could lead to a contentious legal claim as both parties contend with the unpredictable nature of weather and its impact on the accident.
