How Can I Prove That My Injuries Were Caused by the Car Accident?

Car accident victims often suffer severe injuries, with many struggling to recover adequate compensation from insurance. To recover compensation for your losses, you will need to prove the other party’s negligence and explain how that person’s carelessness contributed to your injuries. Proving liability can be challenging, but you will only be entitled to compensatory damages if you can also prove that your injuries were directly caused by the collision.

Seek Medical Attention Immediately

Crash victims often make the mistake of waiting to receive medical treatment. They may do this if they only sustain some bumps and bruises or other minor injuries. Unfortunately, delaying medical treatment may be grounds for a claim denial. A claims adjuster may claim that your injuries are related to something else or that your worsening condition is the result of your failing to seek treatment in a timely manner. 

Medical Records

By seeking medical attention immediately, the treating physician will conduct a medical examination and order any necessary tests to diagnose your condition. Following any X-rays, MRIs, and CT scans, physician orders will summarize your visit, describe your treatment plan, and include any referrals to specialists. Medical imaging is typically timestamped, including the date and time that the test was taken. If your condition does end up worsening in the weeks following your crash, your medical records will demonstrate that it was not caused by a lack of promptness in receiving care.

Take Photos at the Accident Scene

Once you have moved your vehicle to a safe location, snap pictures of your injuries. Try to check to ensure good lighting and take as many pictures as you come from various angles. The more pictures, the better! If you are unable to do so, ask one of your passengers to take photos for you. Cuts and scrapes may heal after a few days, so it is crucial to get these photos right after the incident.

Obtain a Police Report

Under Florida law, if you are involved in an accident that results in injuries, fatalities, or $500 or more in vehicle or property damage, you must call the police. The officer who responds to the scene will generate a report that will provide a third-party perspective on the accident. The report will detail the date/time/location of the crash, the parties involved, the weather and road conditions at the time, and who the officer believes is at fault. The insurance company will ask for a copy of this report when you submit your claim, so having it can prove invaluable in proving liability.

Get the Names of Any Eyewitnesses

If there are any witnesses, ask if they would be willing to testify on your behalf. If so, write down their names and contact information. If possible, take down a statement from each regarding what they saw and heard immediately before and after the crash.
