Is It Legal to Wear Headphones While Driving?

Generally, it is illegal to wear headphones while driving because it interferes with the motorist’s ability to drive safely, which includes the ability to hear what is going on around them, such as emergency sirens, honking, and beyond. The State of Florida

The State of Florida prohibits drivers from operating a vehicle while wearing headsets, headphones, or any other listening devices. There are, however, exceptions to this rule. Drivers are permitted to wear hearing aids for example, and motorists can use headsets for hands-free calls as long as one earpiece is silenced or not worn. In other words, a driver can wear one earbud for making calls, and this is to help ensure that they can hear the sounds of traffic with the other.

The headphone restriction applies to all motorists, including motorcyclists and bicyclists on major roads. One notable exception is that motorcyclists are permitted to wear helmets with mic sets that don’t touch their ears.

A charge of wearing headphones behind the wheel is a moving violation. There is also, however, the matter of safety to consider.

  • Situational awareness can be diminished by headphones, which can set the stage for accidents.
