Who is liable for injuries that occur during a Florida Concert, Music Festival, or Event?

On Behalf of Rosenthal, Levy, Simon & Sosa

Unfortunately, many attendees at music festivals and concerts have been injured due to the deliberate or careless actions of other concertgoers, the festival security & staff, or the dangerous condition of the premises.

If you have been injured at a Florida Music Festival, Concert or Live Event Rosenthal, Levy, Simon & Sosa can help you get your medical bills covered and any other expenses.

The promoters of live music festivals and concerts try to put together an attractive lineup, stacked with famous headlining acts, while also earning enough money from ticket sales, concessions, programs, and souvenirs to cover the expenses of the venue, the artists, security, and the like.

At the same time, mass amounts of people gather to attend these festivals and concerts excited to have a great time and planning on a really memorable experience. The last place anyone wants to end up is the emergency room. Unfortunately, it happens too frequently that people get injured in the course of going to these large-scale, live events — often it is not their fault.

Many cases have been brought by plaintiffs against music festival promotors under Florida’s ordinary negligence principles where an injured attendee must establish the basic elements of Duty, Breach, Causation, and Damages.

These types of negligence cases involve claims that an attendee was injured during a Florida concert due to the promotor’s failure to adequately control the large crowd or mass gathering. Event promotors and landowners can often be held responsible when injuries are the result of:

  • Being struck, deliberately or accidentally, by another attendee
  • Encouraging dangerous behavior such as moshing & crowd surfing
  • Performers throwing objects from the stage into the crowd
  • Crowd surges or pressing & crushing while entering/exiting the venue
  • Inadequate onsite emergency medical services

Other common Florida music festival injuries involve premises liability claims when an attendee was injured due to the failure of the entertainment organizations, event promotor or landowner to maintain the venue or festival grounds in a reasonably safe condition. When a slippery, defective, or otherwise dangerous condition existed or was created at the music festival, the plaintiff must establish the defendant’s actual or constructive notice of the hazard. In Florida, those in control of the venue can be held liable when injuries are the result of:

  • Falling on slippery floors, excessive mud, or wet grass
  • Hidden hazards such as large rocks, tree roots, or holes
  • Tripping over exposed wires, broken objects, or inflatable couches
  • Inadequate lighting & warnings around off-limits or dangerous areas
  • Collapsing scaffolding, sound systems, stages, or art installations

In Florida, accidents can happen at music festivals and live concerts that are caused by festival security guards and negligent staff. These additional claims are based on various theories of liability against the defendant including negligent hiring, retention, and supervision. Music festival promotors, property owners, and even governmental entities can be held responsible when serious bodily injuries, drug injuries and even death are the result of:

  • Assaults in the parking lot or other locations outside & nearby the venue
  • Excessive force or inappropriate conduct of security guards & staff
  • Knowingly permitting the use & sale of illicit drugs, alcohol, or weapons
  • Violation of Florida statutes & regulations setting a standard of conduct
