The Injury Cases We Handle Across St. Lucie County

calendar and gavel representing Florida two year personal injury filing deadline

We take cases where someone else's carelessness caused a lasting physical injury. In practice, that covers a wide range of situations in this county.

Motor vehicle collisions, which remain the largest category. Port St. Lucie police recorded 5,540 crashes in 2024, roughly 15 a day.

Commercial vehicle and delivery truck crashes, a growing share as distribution operations expand along the Tradition corridor.

Motorcycle, bicycle and pedestrian collisions, where injuries tend to be severe and insurers tend to be aggressive.

Slip, trip and fall injuries in stores, parking lots, apartment complexes and commercial properties.

Workplace injuries and workers' compensation claims, including construction, warehousing and healthcare.

Dog bites and animal attacks, which Florida handles under a strict liability standard rather than the one-bite rule used elsewhere.

If you are unsure whether what happened to you fits, call and describe it. The answer takes a few minutes and costs nothing.

Why Does St. Lucie County's Growth Matter to Your Claim?

Because the volume changed faster than the infrastructure did, and both sides know it.

The Census Bureau's Vintage 2025 estimates put Port St. Lucie at 268,062 residents, an increase of 9,131 people in a single year. That was the ninth largest numeric gain of any city in the United States.

Here is the part people get wrong. Port St. Lucie is not a dangerous city by the numbers. Measured per capita, it ranked third safest among nineteen Florida cities over 100,000 residents. The raw crash count is high because the city is enormous and still filling in, not because drivers here are unusually reckless.

That distinction is useful when an insurer implies your crash was routine. Volume is not the same thing as inevitability, and a defendant does not get credit for being one of thousands.

The county is actively rebuilding around the growth. St. Lucie County is spending $5.1 million to replace the two-way center turn lane on Prima Vista Boulevard between Airoso Boulevard and U.S. 1 with a raised median, and projects up to a 22% crash reduction from removing those conflict points. The St. Lucie Transportation Planning Organization has widenings queued for Kings Highway, Jenkins Road and St. Lucie West Boulevard.

Roads that are being fixed are, by definition, roads that were causing crashes.

One Trauma Center, and What That Means for Your Records

Seriously injured people in this county generally end up in Fort Pierce, and knowing that in advance matters more than people expect.

St. Lucie County has one trauma center: HCA Florida Lawnwood Hospital in Fort Pierce, verified at Level II by the state. Neither Martin nor Indian River County has one at all, according to the Florida Department of Health's trauma system.

Cleveland Clinic Tradition Hospital on Innovation Way runs a 24 hour emergency department and is a full campus, but it is not a designated trauma center.

For a claim, that geography creates practical consequences. Records live at more than one facility. Ambulance and air transport records become part of the file. Follow-up care often happens somewhere other than where the emergency treatment did, and gaps between those records are exactly what an adjuster points to when arguing an injury was not serious.

Part of our job is assembling a medical record that reads as one continuous story rather than four disconnected ones.

How Does Florida Law Decide What You Recover?

Three rules do most of the work, and all three changed or tightened recently enough that older advice is unreliable.

How long do you have to file an injury claim in Florida?

Two years from the date of the injury for most negligence claims, under Section 95.11(5)(a). The window was four years before the 2023 tort reform, and claims that arose before that change may still fall under the older period. Understanding the personal injury claim timeline in Florida is essential if you have been sitting on a claim because you remembered a longer deadline. Call now rather than next month.

What happens if you were partly at fault?

Your recovery is reduced by your percentage of responsibility, and eliminated entirely if you are found more than 50% at fault. Section 768.81(6) sets that bar for negligence actions, with medical negligence claims excluded from the rule. Understanding how comparative negligence works in Florida is important because insurers pursue the shared-fault theory hard: moving you from 50% to 51% converts a reduced payout into no payout.

Who pays your medical bills while the claim is pending?

In a vehicle crash, your own Personal Injury Protection pays first regardless of fault. Florida requires at least $10,000 in PIP, and Section 627.736 requires initial care within 14 days of the crash. The full $10,000 applies only where a qualified provider determines an emergency medical condition existed. Otherwise reimbursement is capped at $2,500.

In a premises or workplace case, the sources are different, and sorting that out early is one of the first things we do.

What a St. Lucie County Injury Claim Accounts For

best lawyers logo

Claim value depends on the injury, the available insurance, and how well the file documents both. Nobody can responsibly quote a figure before reviewing medical records.

What a claim generally accounts for:

CategoryWhat it coversWhat insurers tend to dispute
Past medical expensesEmergency care, imaging, surgery, therapyWhether treatment was reasonable and related
Future medical careOngoing treatment, injections, revision surgeryWhether future care is reasonably certain
Lost incomeTime missed during treatment and recoveryDocumentation, especially for self-employed clients
Lost earning capacityWork you can no longer do the same wayWhether the limitation is permanent
Pain and limitationPhysical suffering and effect on daily lifeIn vehicle cases, whether Florida's no-fault injury threshold is met
Property damageVehicle, bicycle, personal propertyValuation and diminished value

In a vehicle case, reaching pain and suffering damages requires meeting the threshold in Section 627.737(2): significant and permanent loss of an important bodily function, permanent injury within a reasonable degree of medical probability, significant permanent scarring or disfigurement, or death.

Where Do St. Lucie County Injury Cases Get Filed?

In the Nineteenth Judicial Circuit, which covers St. Lucie, Martin, Indian River and Okeechobee counties.

The main St. Lucie County courthouse is at 218 South 2nd Street in Fort Pierce. There is also a courthouse annex at 250 NW Country Club Drive in Port St. Lucie, which is the one most residents on the western side of the county actually use.

Most claims never reach either building. They resolve through negotiation, and they resolve better when the other side believes the file is ready for a courtroom. Preparing a case as though it will be tried is not posturing. It is the leverage.

Five Things That Protect a Claim Early

A handful of steps in the first days protect a claim more than anything a lawyer can do months later.

Get medical attention and keep going. Gaps in treatment are the single most common argument used to reduce a claim. If you cannot afford care, tell us and we will discuss options rather than have you stop.

Photograph everything while it still looks like it did. The scene, the vehicles, the hazard, your injuries as they develop, and the shoes you were wearing if you fell.

Report the incident properly. A crash report, a store incident report, an injury report to your employer. Verbal notice tends to disappear.

Decline the recorded statement to the other side's adjuster. You are not required to give one, and it is requested early precisely because your injuries are not yet diagnosed.

Do not post about it. Adjusters look, and a photograph of you at Clover Park will be offered as proof you are fine.

Why People in Port St. Lucie Hire Our Firm

Rosenthal Levy Simon Sosa Logo

Because we have been doing this in this county for a long time, from an office here rather than a satellite address.

Rosenthal, Levy, Simon & Sosa Injury Lawyers has been in practice since 1985, with offices in West Palm Beach and Port St. Lucie. Our attorneys and staff are bilingual in English and Spanish, and Spanish-language representation is a core part of what we do rather than a translation service.

What that looks like on a file:

  • We gather records from every facility involved, including the Fort Pierce trauma admission and the follow-up care that happened elsewhere
  • We identify all available coverage, which frequently includes policies clients did not know applied to them
  • We handle adjuster contact from the first call so the early narrative does not set against you
  • We prepare the claim to be tried, whether or not it ends up being tried

There is no fee for the consultation and no fee unless we recover for you.

Personal Injury Questions From St. Lucie County Clients

Do I need a lawyer, or can I handle a small claim myself?

Some claims genuinely do not need one, and we will tell you when yours is one of them. The line usually falls where the injury required more than a single visit, where fault is contested, or where an adjuster has already made an offer. If you are not sure, a free conversation costs you nothing and often clarifies it in ten minutes.

Do I have to travel to Fort Pierce for my case?

Usually not for the day to day work, which happens by phone, email and at our St. Lucie West office. Filings go to the Nineteenth Judicial Circuit, and there is a courthouse annex on NW Country Club Drive in Port St. Lucie as well as the main courthouse in Fort Pierce. Most claims resolve without either building.

How soon after an injury should I contact an attorney?

Sooner than most people do. Evidence disappears on its own schedule: store video overwrites, vehicles get repaired, witnesses move. Early contact also means you have someone answering the insurance calls while you focus on treatment. There is no advantage to waiting and several concrete disadvantages.

The insurance company already offered me money. Should I take it?

Not before you know what your medical care will actually cost. Early offers arrive before a diagnosis is complete, which is what makes them cheap. Once you accept and sign a release, the claim is closed even if you need surgery three months later. Have the offer reviewed first.

I was hurt at work. Is that a workers' compensation claim or an injury claim?

It can be both, and the distinction matters financially. Workers' compensation covers medical care and a portion of lost wages regardless of fault, but does not pay for pain and suffering. Knowing how to file a workers’ compensation claim is important when seeking these benefits. Where a third party caused the injury, a separate claim may exist alongside it. Understanding both options is important for maximizing compensation in personal injury cases. We handle both and can tell you which applies.

The County Changed. The Deadline Did Not.

St. Lucie County will keep growing, the roads will keep being rebuilt, and the number of people on them will keep going up. None of that helps the person who was injured last Tuesday.

What helps is documentation, coverage that gets identified rather than assumed, and a claim built before the two year window closes.

If you were hurt anywhere in Port St. Lucie, Fort Pierce or St. Lucie County, call us. The consultation is free, we are available at any hour, and we work in English and Spanish.
