Pursuing compensation after a car crash as a passenger

On Behalf of Rosenthal, Levy, Simon & Sosa | Jul 31, 2020 | Car Accidents

Many Florida residents choose to ride in a vehicle as a passenger rather than drive. Sometimes, it is more convenient to catch a ride with a friend or Uber than to drive yourself to an intended destination. Of course, that means that you do not have control over the vehicle, and if your driver or another driver acts negligently or recklessly, you could end up injured in a crash.

Unfortunately, it is not uncommon for passengers to suffer injuries in car accidents, and severe crashes can cause harm to multiple individuals. Even though you were not driving, you still have options for seeking compensation for the harm you suffered in the event.

Filing insurance claims

If the car accident is caused by the driver of another vehicle, filing an insurance claim against that other driver is a wise option. However, it is important to keep in mind that the payout provided by an insurance company could prove rather low if more than one person suffered injuries. Often, insurance policies have a limit on the amount of funds available to cover injured parties.

You could also file an insurance claim with the person driving the vehicle you were in at the time of the crash. It is understandable if you do not want to file a claim with a friend or loved one’s insurance and potentially cause hardships for them, but it is important to remember that the point of insurance is to cover policyholders in such events. Plus, you are not technically going after a friend’s money but, rather, the insurance company’s.

Should you use your own insurance?

Even though you were not driving at the time of the incident, your own car insurance policy may cover your medical bills and other allowable expenses. However, it is important to remember that filing a claim with your own insurance could affect your rates.

What about legal options?

In many cases, the offer made by insurance companies for compensation after a car accident is not enough to cover medical bills, lost wages and other financial difficulties stemming from a crash. If you believe that you will not receive enough compensation for damages you suffered, you may want to consider your legal options. Filing a personal injury claim against the driver considered at fault for the incident could allow you to pursue the amount of compensation you truly need.

If it wasn’t for your help, I know I wouldn’t have been able to win my case. I know that it was far away for you to come to Miami but your professionalism was outstanding. I will always recommend you.

You might say you were even just doing your job, however, I think it’s essential that you realize how fortunate I am to have such a trusted esteemed attorney in my corner, blessed really.
