Insurance Questions and Covid-19
I own a business and I want to know if my insurance covers various losses caused by the coronavirus?
The COVID-19 virus is having a significant economic impact on small and large businesses in South Florida.
Business insurance is designed to cover unexpected loss or damage caused by an unanticipated event.
The havoc wreaked by the Coronavirus is causing a lot of business interruptions and an economic loss.
Examples of impacts to your business caused by the Coronavirus include:
- Cost of cleaning and sanitizing
- Costs associated with temporarily closing your business
- Loss of income due to not being able to access the location of your business such as a shopping mall because it is closed
- Loss of income because you cannot access the products that you need to conduct business such as a supplier is closed
- Extra expenses incurred to minimize or mitigate business income losses
If think you are a business that has been impacted by COVID-19, and want to file a claim against your insurance, call Rosenthal, Levy, Simon & Sosa 561-331-5134 for a free consultation.
My business has lost a lot of money. Does my business interruption insurance cover my losses?
There are different circumstances such as specific policy language and we suggest you consult with a lawyer.
The trigger of coverage for any policy of this sort is “direct physical damage” to the insured premises.
You might argue that loss or damage caused by the coronavirus pandemic does not constitute direct physical loss to the insured property.
There is some precedent to argue, that these widespread losses should be covered.
If think you have a claim against your insurance policy, please call Rosenthal, Levy, Simon & Sosa today 561-331-5134.
My policy has Civil Authority Coverage. What does that cover?
Most policies typically include “Civil Authority” coverage, which provides coverage of a loss that is caused by a directive from a governmental authority which impairs or denies access to the insured property. The policy language is especially critical as some policies impose the physical damage requirement while others do not.
Rosenthal, Levy, Simon & Sosa would be happy to review your policy free of charge.
How do I know if I have an endorsement in my standard policy?
Recently, many insurers have included an endorsement in their standard policies which expressly excludes from coverage loss or damage caused by virus of any type. There are policies that were written with specific industries in mind, such as restaurants, nightclubs, retail establishments and entertainment venues. Check your policy for clauses titled, “Special Perils Business Interruption,” “Communicable Diseases” and “Loss of Attraction.” These may provide an avenue for insurance coverage.
