Unpaid Overtime & Commissions
Working overtime is hard enough. Not being paid properly or sufficiently is not only unfair, it is unlawful. Federal laws exist to ensure employees are paid sufficiently and fairly.
Do you get paid time and a half for every hour over 40 hours you work? Were you paid time and a half at your previous job? If not, you may be entitled to recover back pay for as much as three years. Ask yourself the following questions:
- Question: Did you make less than $100,000 per year, work over 40 hours in a week and receive no overtime pay?
- Question: Did you get “comp time” instead of money in your paycheck?
- Question: Were your hours “rounded off” to 40?
- Question: Did you take home work, or work during “off clock” periods, such as during meals and before or after your regular shift?
If you answered yes to any of these questions, you may be entitled to overtime pay.
Beyond the basic questions above, many other factors determine whether you are entitled to overtime pay. People work overtime and don’t even know it. Coming to work early and leaving late, even if you’re “off the clock” is still work and you should be paid. Your boss knows this, but will never tell you. At the Law Offices of Rosenthal, Levy & Simon we’ll inform you of all of your rights under the law and work to get you what you deserve.
